These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Author,” or “you”) and EbookAI Inc. (“EbookAI,” “we,” “us,” or “our”). By accessing or using our website, web application, APIs, and book generation services (collectively, the “Service”), you agree to be bound by these Terms and our accompanying Privacy Policy.
If you do not agree to these Terms, you must immediately cease accessing and using the Service. If you are entering into these Terms on behalf of a company, organization, or educational institution, you represent and warrant that you have full legal authority to bind that entity.

As between you and EbookAI, you retain sole and exclusive ownership of all right, title, and interest (including all copyright, trademark, and other intellectual property rights) in and to:
All raw ideas, source notes, audio transcripts, or uploaded materials you provide.
All chapter outlines, generated manuscript drafts, revised text, and final book interiors.
All custom covers, spine wraps, and 3D mockups generated within your account.
All exported publication binaries, including .epub and .pdf files.
0% Royalty Share: EbookAI claims no royalty rights, revenue shares, or commercial commissions from any distribution of your books. Whether you earn $10 or $1,000,000 via Amazon Kindle Direct Publishing (KDP), Apple Books, Barnes & Noble, IngramSpark, Gumroad, Kickstarter, or personal client sales, 100% of those proceeds belong entirely to you.
4. User Accounts & Security
To access the Service, you must register an account using a valid email address or authenticated Google OAuth sign-in. You must be at least 18 years of age or the age of majority in your jurisdiction.
You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify EbookAI immediately at support@ebookai.com if you suspect any unauthorized access or security compromise.
5. Acceptable Use Policy
You agree to use the Service in full compliance with all applicable local, national, and international laws. You shall not use EbookAI to create, generate, store, or distribute:
Content that depicts, promotes, or facilitates child sexual exploitation or abuse.
Defamatory, libelous, unlawful, or intentionally fraudulent material.
Direct incitement to violence, terrorism, or severe illegal harm against individuals or groups.
Materials that infringe upon the valid copyrights, trademarks, or proprietary rights of any third party.
Automated scraping bots, denial-of-service exploits, or attempts to circumvent rate limits or security layers.
EbookAI reserves the right to suspend or terminate accounts that violate this Acceptable Use Policy without advance notice or refund.
6. AI Content & Author Due Diligence
EbookAI employs advanced state-of-the-art language models (including DeepSeek-R1 and DeepSeek-V3). Because of the probabilistic nature of machine learning, AI outputs may occasionally contain factual inaccuracies, omissions, or unintended hallucinations.
Author Verification Responsibility
You acknowledge that you are the ultimate publisher and author of record for any work exported from EbookAI. You are solely responsible for conducting editorial review, fact-checking citations, verifying medical, legal, or financial statements, and ensuring your final manuscript complies with the publishing guidelines of your chosen distributor (e.g., Amazon KDP Content Guidelines).
7. Credits, Subscriptions & Refunds
Credits: EbookAI utilizes a transparent credit-based ledger for generating outlines, drafting chapters, and synthesizing covers. New accounts receive 5 free credits upon email verification. Additional credits may be purchased via one-time packs or recurring subscriptions.
Subscriptions & Cancellation: Paid subscriptions renew automatically on a monthly or annual basis unless canceled prior to the renewal date. You may cancel your subscription at any time with a single click inside your Account Settings. Upon cancellation, you retain full access to your account and generated files until the conclusion of your billing cycle.
Refunds: Because computation costs (GPU time, reasoning tokens, and S3 asset storage) are consumed immediately during book generation, purchases are generally non-refundable. However, if a documented technical malfunction prevented the delivery of your book files, please email billing@ebookai.com within 14 days of purchase for a manual review.
8. Platform Intellectual Property
While you own all output and manuscripts you produce, EbookAI and its licensors retain all right, title, and interest in the underlying Service, including software code, algorithms, interface designs, logos, trade secrets, and system documentation. You may not reverse-engineer, decompile, or create unauthorized derivative works of the EbookAI software platform.
9. Limitation of Liability & Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
IN NO EVENT SHALL EBOOKAI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BOOK ROYALTIES) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO EBOOKAI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Termination & Data Portability
You may terminate your account at any time by selecting “Delete Account” in your profile settings. Upon deletion, all personal data, manuscripts, drafts, and S3 assets will be permanently purged in accordance with our Privacy Policy. You are advised to download and export all .epub and .pdf publication files prior to initiating account deletion.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from these Terms shall first be submitted to informal good-faith negotiation by contacting our legal counsel at legal@ebookai.com.
